These Terms & Conditions (“Terms”) form a binding agreement between you and Fetchitt (“we”, “us”, “our”) and govern your access to and use of our website, mobile applications, and services (collectively, the “Service”). By creating an account or using the Service you agree to these Terms.
1. Acceptance of terms
You must be at least 18 years old and legally able to enter into a binding contract to use the Service. If you are using the Service on behalf of a business, you represent that you are authorised to bind that business to these Terms.
2. Accounts
A single Fetchitt account can operate in two modes — as a client (posting jobs) and as a professional (buying leads). You are responsible for:
- Providing accurate registration information and keeping it up to date.
- Maintaining the confidentiality of your login credentials.
- All activity that occurs under your account.
Notify us immediately at support@fetchitt.com if you suspect unauthorised access.
3. Clients & posting jobs
Clients may post job requests (“leads”) describing work they want performed. By posting a lead you confirm that:
- The information you provide is accurate and complete.
- You genuinely intend to hire a professional for the work described.
- You consent to your contact details being shared with matched professionals who unlock your lead.
Posting a lead is free. Fetchitt does not employ or endorse the professionals who respond and does not perform the underlying work.
4. Professionals & buying leads
Professionals pay credits to unlock the contact details of a lead. When you unlock a lead you agree to:
- Contact the client promptly and only in relation to the work they posted.
- Hold appropriate licences, insurance, and certifications for the services you offer.
- Deliver the work you contract for at your quoted price and quality.
A lead may be sold to up to 5 professionals unless it is purchased on an exclusive basis, in which case no further professionals will be able to unlock it.
5. Credits, payments & refunds
Credits are the internal currency used to unlock leads. Credits are purchased in packs and are non-transferable. Prices, taxes, and applicable fees are shown at checkout. Payments are processed by our payment provider Stripe.
Refunds. Unused credits are non-refundable except where required by law. If a lead turns out to be fraudulent, uncontactable, or materially misdescribed, contact us within 7 days of unlocking it and we may refund the credits used at our discretion.
6. Acceptable conduct
You agree not to:
- Post false, misleading, or fraudulent leads or profile information.
- Use the Service to harass, defame, or discriminate against any person.
- Contact clients or professionals outside the scope of the work posted.
- Circumvent, disable, or interfere with security-related features of the Service.
- Scrape, resell, or otherwise redistribute lead data or profile data.
7. User content
You retain ownership of the content you submit (profile text, images, lead descriptions, reviews). By submitting content you grant Fetchitt a worldwide, non-exclusive, royalty-free licence to host, display, and distribute that content for the purpose of operating and promoting the Service.
8. Intellectual property
The Service, including its design, code, trademarks, and content (excluding user content), is owned by Fetchitt and protected by intellectual property laws. You may not copy, modify, or create derivative works without our written consent.
9. Disclaimer of warranties
The Service is provided “as is” and “as available”. To the fullest extent permitted by law we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that any lead will result in a booking, or that any professional will meet your expectations.
10. Limitation of liability
To the maximum extent permitted by law, Fetchitt will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill arising out of your use of the Service. Our aggregate liability in any 12-month period will not exceed the amounts you paid to us in that period.
11. Suspension & termination
We may suspend or terminate your account at any time if we reasonably believe you have breached these Terms, engaged in fraudulent activity, or created legal risk for us or other users. You may close your account at any time by contacting support@fetchitt.com.
12. Governing law
These Terms are governed by the laws of the jurisdiction in which Fetchitt is established, without regard to conflict-of-law rules. You agree to submit to the exclusive jurisdiction of the courts of that jurisdiction for any dispute arising from these Terms.
13. Changes to these terms
We may update these Terms from time to time. Material changes will be communicated by email or via a notice on the Service. Continuing to use the Service after changes take effect constitutes acceptance of the updated Terms.
